Notice of Intent to Request Release of Funds (NOI-RROF) January 12, 2021 Floyd County 120 W Oxford Street Floyd, VA 24091 540-745-9300 On or about January 21, 2021 Floyd County will submit a request to the Virginia Department of Housing and Community Development (DHCD) for the release of Community Development Block Grant funds under Title I of the Housing and Community Development Act of 1974 (PL 93-383), as amended, to undertake a project known as the Floyd County Scatter-Site Housing Rehabilitation Project, for the purpose of rehabilitating or substantially reconstructing approximately 15 homes in the County of Floyd. The activities proposed are categorically excluded under HUD regulations 24 CFR Part 58 from National Environmental Policy Act requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at 120 West Oxford Street, Floyd, VA 24091 and may be examined or copied weekdays 9 A.M. to 4:30 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to Floyd County, 120 West Oxford Street, Floyd, VA 24091. All comments received by January 20, 2021 will be considered by the Floyd County prior to authorizing submission of a request for release of funds. Commentors should specify which Notice they are addressing. RELEASE OF FUNDS Floyd County certifies to DHCD that Cynthia Ryan in her capacity as Acting County Administrator consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. DHCD'S approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Floyd County to use Program funds. OBJECTIONS TO RELEASE OF FUNDS DHCD will consider objections to its release of funds and Floyd County's certification received by February 5, 2021 or for a period of fifteen days following its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of Floyd County; (b) Floyd County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by DHCD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
